I. Opening

The phenomenon of financial transactions by using cryptocurrencies has occurred around the world. Previously cryptocurrencies only performed as a part of trading instruments. Nowadays, famous brands started to approve cryptocurrencies as part of their payment method, among others the branded bags Gucci, as stated on the official website of BBC on May 6th 2022. Estimated started in 2009, cryptocurrencies are now growing up and become an easier and affordable payment transaction for citizens. This could be concluded as the fresh innovation on the global fintech industry.

Cryptocurrencies were born not by the specific central government, nor regulated by the specific regulation. This then became the debate among banks, institutions and governments around the world. The debates among them are concerning the legality of cryptocurrencies as payment instruments and the uniformity of the definition of cryptocurrencies itself. One of the aims of debates is to protect citizens’ rights if there are any criminals against them because of this cryptocurrencies transaction, and also to avoid financial crimes such as money laundering.

Tindak pidana pokok dari TPPU sebagaimana diatur dalam UU TPPU adalah korupsi, penyuapan, tindak pidana narkotika dan psikotropika, penyelundupan tenaga kerja, penyelundupan migran, tindak pidana di bidang perbankan, tindak pidana di bidang pasar modal, tindak pidana di bidang perasuransian, tindak pidana kepabeanan dan cukai, tindak pidana perdagangan orang, tindak pidana perdagangan senjata gelap, tindak pidana terorisme, penculikan, pencurian, penggelapan, penipuan, pemalsuan uang, perjudian, prostitusi, tindak pidana di bidang perpajakan, tindak pidana di bidang kehutanan, tindak pidana di bidang lingkungan hidup, tindak pidana di bidang kelautan dan perikanan, dan/atau tindak pidana lain yang diancam dengan pidana penjara 4 (empat) tahun atau lebih yang dilakukan di dalam maupun di luar yurisdiksi Indonesia dan tindak pidana tersebut juga merupakan tindak pidana menurut hukum Indonesia.

I. Latar Belakang

Pada tanggal 26 Januari 2022, Menteri Hukum dan Hak Asasi Manusia telah menerbitkan Peraturan Nomor 6 tahun 2022 tentang Layanan Legalisasi Apostille. Peraturan ini merupakan pengejawantahan dan tindak lanjut dari Convention Abolishing the Requirement of Legalisation for Public Documents yang telah disahkan melalui Peraturan Presiden Republik Indonesia Nomor 2 tahun 2021. Legalisasi Apostille (selanjutnya disebut sebagai “Apostille”) merupakan tindakan terhadap dokumen publik berupa pengesahan tanda tangan pejabat, pengesahan cap maupun segel resmi. Dokumen yang boleh dimohonkan Apostille hanyalah dokumen publik berupa surat tertulis atau tercetak lengkap dengan tanda tangan pejabat publik dan cap institusi yang berwenang dan telah lolos verifikasi.

I. BACKGROUND

The debates on the policy of the obligation for coal companies to use national vessel as the sea delivery transportation for coals has been raised since 2019. This policy is recognise in the form of Ministry of Trade of the Republic of Indonesia (MOT) Regulation number 82 of 2017 and has been amended with the MOT Regulation number 80 of 2018 that should be applied effectively on May 1st 2020. This Trade Minister Regulation is the derivative of the Economic Policy Package Volume XV to increase the competitiveness of the logistics industry in Indonesia. This is an interesting case for stakeholder analysis not only because involving 5 (five) stakeholders from private and public sector, but also because each stakeholders has their own perspective with strong reason that all of them are important for Indonesia and so with the background of this policy.

I. PENDAHULUAN

Sejak dulu, para ahli hukum sudah berpendapat bahwa pengaturan khusus terkait segala perbuatan hukum yang terjadi di maupun melalui laut penting untuk disusun dan diterapkan, khususnya tentang angkatan laut. Hal ini dikarenakan gelombang air laut yang senantiasa bergerak dan tidak dapat dikendalikan oleh manusia. Perubahan titik batas daratan dengan laut yang berakibat pada hak lintas tiap negara, sapuan ombak, bajak laut, transaksi perdagangan dengan moda transportasi laut, hingga kerusakan barang angkutan akibat air laut menjadi beberapa pertimbangan penyusunan regulasi tentang kemaritiman, salah satunya tentang asuransi angkutan laut.

Di Indonesia, kegiatan pengangkutan barang dengan moda transportasi laut diatur dalam Kitab Undang-Undang Hukum Dagang (KUHD), UU No 17 tahun 2008 tentang Pelayaran, dan Peraturan Pemerintah No 20 tahun 2010 tentang Angkutan di Perairan sebagaimana telah diubah dengan Peraturan Pemerintah No 22 tahun 2011 tentang Perubahan atas Peraturan Pemerintah Nomor 20 Tahun 2010 tentang Angkutan di Perairan.

I. Pengangkutan Minyak Kelapa Sawit

Keadaan geografis Indonesia yang terdiri dari ribuan pulau memerlukan upaya dan strategi khusus untuk pemerataan pemenuhan kebutuhan masyarakat di Indonesia. Maka transportasi laut memegang peranan penting untuk mendistribusikan kebutuhan masyarakat antar pulau. Salah satu kebutuhan yang dilakukan dengan transportasi laut adalah pendistribusian minyak kelapa sawit (Crude Palm Oil / CPO).

Minyak kelapa sawit / CPO menjadi salah satu muatan dalam cargo yang rutin dilakukan pengirimannya melalui jalur laut. Hal ini dikarenakan minyak kelapa sawit / CPO sampai saat ini masih menjadi bahan dasar minyak goreng, kosmetik, biodiesel, pasta gigi, cat dan lain-lain.

Since 1994, arbitration has been the most popular means of resolving maritime proceedings. Under Annex VII to the United Nation Convention of the Law Of the Sea (UNCLOS), the court consists of 5 arbitrators, each party to the dispute appoints one arbitrator and they jointly appoint three others. In case, it is required, the President of International Tribunal of the Law Of the Sea (“ITLOS”) authorized to appoint the Chief of Panel of Arbitrators.
